On February 23, 2026, a Joint Statement on AI-Generated Imagery was published by 61 data protection authorities (the “Joint Statement”). The Joint Statement addresses concerns regarding artificial intelligence (“AI”) systems capable of generating realistic images and videos depicting identifiable individuals without their knowledge or consent. The Joint Statement notes particular concern about the potential risks to children and other vulnerable groups, including the possibility of cyber-bullying and exploitation.
The authorities acknowledge that AI technologies, while offering societal benefits, have enabled the creation of non-consensual intimate imagery, defamatory content and other materials that may harm individuals. The Joint Statement reiterates that organizations developing or using AI content generation systems must comply with applicable data protection and privacy laws, noting that non-consensual intimate imagery may constitute a criminal offense in many jurisdictions. To address these significant harms, the signatories call for a coordinated response and commit to sharing information on enforcement, policy, and education approaches, consistent with relevant laws, reflecting a unified effort to address the global risks posed by AI-generated content.
